These terms govern your use of Convrail (the "Service"), operated by ECOM FR LLC ("we", "us"). By installing the app, connecting a store or using this website's forms, you accept them. If you use the Service on behalf of a company, you confirm you have authority to bind it.
1. The Service
Convrail connects e-commerce stores to the ChatGPT channel: it installs a browser pixel and sends server-side conversion events to the OpenAI Conversions API, builds and delivers a product feed following the OpenAI product feed specification, and attributes orders to ChatGPT organic or ChatGPT ads. The Service is provided through apps for Shopify, WooCommerce and BigCommerce and through an authenticated API bridge.
Features may be added, changed or removed over time. We will announce material changes in the app or by email to the address on your account.
2. Your account and store
- You must own or be authorized to operate every store you connect.
- You are responsible for the OpenAI, Shopify, WooCommerce or BigCommerce accounts you connect and for keeping their credentials valid. We store them encrypted and use them only to operate the Service for your store.
- You must keep the email address on your account current; it is how we reach you about alerts, security and changes to these terms.
3. Your obligations
- You remain responsible for the content of your product feed: accuracy of prices, availability, descriptions, images and legal mentions, and for their compliance with the laws of the countries you target.
- You remain responsible for obtaining any consent required from your visitors before tracking them, through the consent tools of your platform. The pixel follows the consent state your store exposes; you decide what that state is.
- You must comply with the terms of OpenAI, Shopify, WooCommerce, BigCommerce and any other third party whose services the Service connects to on your behalf.
- You must not use the Service to send data you have no right to process, to circumvent rate limits or security measures, to reverse engineer the software, or to resell it without a written agreement.
4. Data and privacy
How we process personal data is described in our privacy policy. For the data of your customers that we process on your instructions, we act as your processor under the data processing addendum in section 5. Emails, phone numbers, names and customer IDs are hashed before they are stored or transmitted, and an automated guard blocks any transmission containing a clear email address, a phone or name field, or an identifier that is not a valid hash.
5. Data processing addendum
This addendum applies to the personal data of your store's customers that we process to provide the Service (Article 28 of the GDPR and equivalent laws). You, the merchant, are the controller; ECOM FR LLC is your processor. Questions about it: [email protected].
- Purpose. We process that data only on your instructions and only to provide the Service: conversion tracking, product feeds, attribution and reporting. We never use it for our own purposes, never sell it and never share it with advertisers.
- Sub-processors. We use the sub-processors listed in section 5 of the privacy policy: Infomaniak for hosting (Switzerland), OpenAI for conversion events and product feeds, Twilio SendGrid for the emails we send to merchants, and an AI writing provider for product copy only if you enable it. We update that list before any new sub-processor receives your customers’ data.
- Security. Secrets and platform tokens are encrypted at rest with AES-256-GCM, all traffic uses TLS, personal identifiers are hashed before storage, an automated guard blocks clear personal data before any transmission, access to store data is restricted and logged, and fixed retention periods are enforced by a daily deletion job.
- Confidentiality. Access to production systems is limited to the people who operate the Service.
- Breach notification. If a personal data breach affects your customers’ data, we notify you without undue delay and in any case within 72 hours of becoming aware of it, with the information available at that time, and we keep you informed as we learn more.
- Data subject requests. We help you answer your customers’ requests (access, correction, deletion). Customer redaction requests sent by the platform are applied automatically: that customer’s events and orders are deleted.
- End of service. When you uninstall the app or the Service ends, we delete your store data, including your customers’ data, as described in the privacy policy.
- Compliance. On request, we provide the information reasonably needed to demonstrate compliance with this addendum.
6. Third-party services
Convrail is independent software. It is not affiliated with, sponsored by or endorsed by OpenAI, Shopify, Automattic, WooCommerce or BigCommerce. ChatGPT and OpenAI are trademarks of OpenAI; Shopify is a trademark of Shopify Inc.; WooCommerce and WordPress are trademarks of their respective owners; BigCommerce is a trademark of BigCommerce Pty. Ltd. Those services are governed by their own terms, and we do not control their availability, their acceptance of your feed or the performance of your advertising.
7. Fees
Convrail offers a free plan and paid plans. The plans, their monthly and yearly prices and the length of the free trial on paid plans are published on the pricing page and in the listing of the relevant app store. On Shopify, paid plans are billed by Shopify, in US dollars, on your Shopify invoice; on WooCommerce and BigCommerce, they are paid by card through Stripe. No charge is made without your explicit subscription. You can change or cancel your plan at any time from within the app, including by returning to the free plan. Taxes may apply.
8. Intellectual property
The software, this website and their content belong to ECOM FR LLC or its licensors. Your store data, product data and customer data remain yours; you grant us the right to process them only as needed to provide the Service.
9. No warranty
The Service is provided "as is" and "as available". We do not warrant that OpenAI will accept your feed, display your products, attribute conversions in any particular way, or that advertising performance will improve. Validation reduces rejections but cannot guarantee acceptance of rules OpenAI has not published.
10. Limitation of liability
To the extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid us in the twelve months before the claim, or 100 US dollars if you paid none. We are not liable for indirect losses, lost profits, lost data or advertising spend. Nothing in these terms limits liability that cannot be limited under applicable law.
11. Termination
You may stop using the Service at any time by uninstalling the app or disconnecting your store. We may suspend or terminate access for breach of these terms, for security reasons or if the Service is discontinued, with notice where possible. On termination we delete your store data as described in the privacy policy.
12. Governing law
These terms are governed by the laws of Wyoming, United States, without regard to conflict of law rules. Mandatory consumer protection rules of your country of residence are not affected.
13. Changes and contact
We may update these terms; the date at the top of this page is the date of the current version, and material changes are announced in the app or by email. Questions: [email protected], or the contact page.
